The app itself is licensed to you under Apple’s Standard End User License Agreement (the “Apple EULA”), which applies to every app you download from the App Store.
This page covers what the Apple EULA does not: your account, your subscription, leagues and groups, and what you may and may not do with other people around. If the two ever contradict each other on the licence to the software, the Apple EULA wins.
By downloading Stitchkin, creating an account or using the app you accept these terms and the Privacy Policy. If you do not accept them, do not use the app.
Stitchkin is published by DEVELOPER LEGAL NAME, POSTAL ADDRESS, contactable at support@stitchkin.com.
You must be at least 13 years old — 16 in countries where that is the age of digital consent — and able to enter into a contract where you live. One account belongs to one person; keep the Apple Account or Google account you sign in with to yourself, because anyone holding it holds your subscription too.
Stitchkin reads cross-stitch charts you already own, helps you keep your place while you stitch, and counts what you have done. Reading a printed chart is a best effort, not a guarantee: recognition of pages, grids, symbols and legends depends on the file you bring, and part of the app’s job is to let you correct it by hand. We do not promise that any particular chart will be recognised, only that you can fix it when it is not.
Charts, progress and photos live on your device. Keeping your own backup — iOS backup, iCloud, or both — is your responsibility; if you delete the app or lose the device without one, that work is gone and we cannot restore it.
Stitchkin runs on a subscription. Using the app requires an active one.
Everything you bring to Stitchkin stays yours. We claim no ownership of your charts, photos or notes and, since they do not leave your device, we hold no copy of them.
You are responsible for having the right to use the charts you import. Stitchkin is a tool for stitching patterns you have bought or created; it is not a way to obtain or pass on charts you do not own, and it has no facility for sharing chart files with other people.
For the few things other people do see — your display name, your badge, and the name and emoji of a group you create — you give us permission to show them to the other members of your leagues and groups and inside the app. That permission ends when you change them or delete your account.
Leagues and groups put you next to strangers. The rules for names, badges and groups are in the Community Guidelines, and they are part of these terms. In short: nothing offensive, nothing impersonating someone else, no advertising, no faking your stitch count.
If you break them we may rename or remove content, take you out of a group or a league, suspend the account or close it. Serious cases — anything illegal, or anything that endangers someone — are acted on immediately. You can appeal any of it by writing to support@stitchkin.com.
You also agree not to work around the subscription, take the app apart to bypass its checks, hammer our servers automatically, or use anyone else’s account.
Stitchkin is developed continuously: features are added, improved and occasionally retired. Where a change removes something you actively rely on, we will say so in the release notes. We may also stop offering the service altogether — in that case we will give reasonable notice in the app, and unused paid time will be refundable through Apple.
Stitchkin reads thread numbers from the DMC palette and opens chart files produced by other programs, purely so that charts you already own can be used. The companies behind those threads, programs and file formats are not affiliated with Stitchkin and do not endorse it. Details are on the Acknowledgements page.
Except where the law says otherwise, Stitchkin is provided as it is, without warranties that it will be uninterrupted, error-free or suitable for a particular purpose. To the extent permitted by law, our liability for any claim connected to the app is limited to what you paid for it in the twelve months before the claim, and we are not liable for indirect or consequential loss, or for lost work you did not back up.
None of this limits your rights as a consumer. If the law where you live gives you guarantees that cannot be excluded, they apply, and nothing here removes them.
Apple is not a party to these terms and has no obligation to provide support for Stitchkin. Apple is, however, a third-party beneficiary of these terms and may enforce them against you. Claims about the app — defects, intellectual property, product liability, or a failure to meet a legal requirement — are for us to answer, not Apple.
You can stop at any time: cancel the subscription through Apple, and delete the account in Settings → Delete account (see what that removes). We may suspend or close an account that breaks these terms or the Community Guidelines, or where we are required to by law; unless the reason makes it impossible, we will tell you why.
These terms are governed by the law of COUNTRY / STATE, without regard to its conflict-of-law rules, and disputes belong to the courts of COUNTRY / STATE. If you are a consumer in the EEA or the UK, this does not deprive you of the protection of your own country’s mandatory law, and you may bring proceedings where you live.
We update the date at the top when these terms change. Material changes are announced in the app before they take effect; continuing to use Stitchkin after that means you accept them, and if you do not, you can cancel and delete your account.
